e) if vital interests of the person concerned or another natural person requires the processing of their data, the legal basis shall be Art. 6 paragraph 1 (d) of the GDPR.
f) if processing of data is necessary for the protection of legitimate interests of our company or a third party, and does not overshadow the interests, fundamental rights and freedoms of the person concerned, then Art. 6 paragraph 1 (f) of the GDPR is the legal basis for it.

Duration of Storage
Your personal and/or telematic data are stored on Tracks GmbH data server at AWS data center (Frankfurt) for the time required for the implementation of the company's services and will be deleted as soon as they are no longer necessary for our purposes to process. For example, upon withdrawal of your registration on our website.
Personal messages received by Tracks GmbH through our Contact Form or via e-mail will be deleted as soon as the respective conversation with the client is over or the matter in question is clarified. Any additional personal data collected during such communication process will be deleted after a period of seven days.

Tracks uses e-mail marketing in the form of e-mail newsletter sent out to registered parties. Tracks collects the following data:

- Mailchimp automatically places single pixel gifs, also known as web beacons, in every email sent by our Members. These are tiny graphic files that contain unique identifiers that enable Mailchimp and Tracks to recognize when contacts have opened an email or clicked certain links. These technologies record each contact's email address, IP address, date, and time associated with each open and click for a campaign. Mailchimp uses this data to create reports for Tracks about how an email campaign performed and what actions contacts took.

For security reasons, to protect the transmission of confidential content, we use the SSL/TLS encryption on our website. The encryption can be detected by changing the address line of your browser from 'http: //' to 'https: //' - in this case a lock symbol appears. Only after your consent and in order to carry out our services we can access and process your telematic data from such third-party websites and platforms/databases like Volvo Connect, RIO, or MAN. Tracks uses this data to analyse, among others, actual fuel consumption, compares this with digital twins of other trucks across fleets and offers recommendations to increase efficiency in operations of trucks. With this data, Tracks offers two services: Tracks for Carriers to help road freight carriers optimize their fuel consumption and Tracks for Shippers to provide shippers a tool to effectively manage the emissions of their carriers.
In accordance with the legal regulations of the GDPR Tracks GmbH does not transfer your personal or telematic data to any third party.
Allowing Tracks GmbH access your personal or telematic data you are entitled of the following rights according to the GDPR:
Right to Withdrawal of Consent:
Under Art. 7 paragraph 3 of the GDPR, you have the right to revoke your consent to the processing of your data at any time and free of charge. To revoke your consent, you can write an informal e-mail with the relevant request to us.
